DPR: Criminal Procedure Code Bill Must Be Completed Quickly Because Other Bills Are Waiting

Deputy Speaker of the Indonesian House of Representatives Adies Kadir said that the discussion of the Draft Law (RUU) on Amendments to Law Number 8 of 1981 concerning Criminal Procedure Law or KUHAP that is rolling in parliament must be completed quickly because there are other bills waiting for the legislative product. He explained that the RUU KUHAP needs to be completed immediately so that the discussion of the revision of Law Number 2 of 2002 concerning the Republic of Indonesia National Police and the Draft Law on Confiscation of Assets Related to Criminal Acts can also be carried out immediately by the DPR together with the Government. "So we hope this is fast, besides that why are we asking for it to be fast? There are two Draft Laws also waiting for this KUHAP, including the Police Bill and the Asset Confiscation Bill. So there are two bills waiting for that," said Adies at the Parliament Complex, Senayan, Jakarta, Tuesday. 

He also said that the Criminal Procedure Code Bill must be completed immediately because it must be synchronized with the Criminal Code (KUHP) which will be effective on January 2, 2026. "We want the Criminal Procedure Code to be completed quickly because the Criminal Procedure Code is a procedural law that implements the Criminal Code. This is the criminal procedure law. So we hope that it will be completed quickly because it must be synchronized with the previous Criminal Code, which has been ratified by the DPR," he said. He also emphasized that the contents of the Criminal Procedure Code Bill must be able to accommodate current developments, one of which is by including the concept of restorative justice in enforcing the law in the country. 

"Adjusting to current conditions, related to legal cases, now there is restorative justice and all sorts of things. Well, that must also be included, so that law enforcement officers, both the police, prosecutors, courts, and also lawyers, and law seekers can get real justice," he said. He also ensured that the discussion of the Criminal Procedure Code Bill in parliament would take place openly by accommodating views and input from various civil circles in the preparation of the legislative product. 

"Before it was submitted to Commission III, they had opened up the widest possible space, and last week until yesterday they also invited all experts, all lawyer associations, the police, the judiciary, IKAHI (Indonesian Judges Association), then the prosecutor's office, all stakeholders related to the law were invited," he said. He then continued, "Because this is the basis of the criminal law that will cover all other lex specialis laws in the field of criminal law because this is the basis, basically, here (the Criminal Procedure Code Bill)." On Tuesday, Commission III of the Indonesian House of Representatives officially began the discussion stage of the Draft Law (RUU) on Amendments to Law Number 8 of 1981 concerning Criminal Procedure Law or KUHAP, after starting a working meeting with the government through the Ministry of Law and the Ministry of State Secretariat. 

Chairman of Commission III of the Indonesian House of Representatives, Habiburokhman, also directly led the Working Committee (Panja) discussing the Draft Law (RUU) on Amendments to Law Number 8 of 1981 on Criminal Procedure Law or KUHAP, as the chairman of the Panja. In addition, other leaders of Commission III of the Indonesian House of Representatives also became leaders of the Panja RUU KUHAP, namely Dede Indea Permana from the PDIP Faction, Sari Yuliati from the Golkar Party Faction, Ahmad Sahroni from the NasDem Party Faction, and Rano Alfath from the PKB Faction.
