Asset Confiscation Bill To Be Taken Over By DPR, Government Resigned

President Prabowo Subianto's desire for the Asset Confiscation Bill to be discussed immediately does not seem likely to be realized in the near future. 

The reason is, the government understands the DPR's desire for the discussion of Asset Confiscation to begin after the ratification of the Draft Criminal Procedure Code (RKUHAP) is complete. Not only that, there is a possibility that the bill needed to eradicate corruption will no longer be a government-initiated bill, but a DPR bill. 

When contacted in Jakarta, Thursday (29/5/2025), the Coordinating Minister for Law, Human Rights, Immigration, and Corrections Yusril Ihza Mahendra said that there is a possibility that the Asset Confiscation Bill, which during the administration of the seventh President of the Republic of Indonesia Joko Widodo was a government-initiated bill, will be taken over as a DPR initiative. 

"I heard that the bill will be taken over as a DPR initiative. Therefore, the government is just waiting for when the DPR will submit it after the discussion of the Criminal Procedure Code Bill is complete," he said. 

The government, he continued, can understand the DPR's desire for the Asset Confiscation Bill to be discussed after the completion of the RKUHAP. 

"I understand the DPR's way of thinking. In handling certain criminal acts, the provisions in the Criminal Procedure Code will apply unless regulated separately in special criminal procedure law. So, the discussion of the Asset Confiscation Bill can only be carried out if the general criminal procedure law has been completed," said Yusril. 

In addition, he saw the urgency of the ratification of the Criminal Procedure Code because the new Criminal Code will come into effect in early 2026. This Criminal Code requires new procedural law because the current Criminal Procedure Code is still an old product, namely Law Number 8 of 1981. 

"The discussion of the Criminal Procedure Code Bill must indeed be completed immediately. The National Criminal Code needs new procedural law. The philosophy used in formulating material criminal law in the National Criminal Code is also very different from the drafting of the New Order Criminal Procedure Code," he explained. 

During the commemoration of Labor Day, May 1, President Prabowo expressed his support for the immediate discussion of the Asset Confiscation Bill. 

This bill was initiated by the Financial Transaction Reports and Analysis Center (PPATK) and was once submitted to the sixth President of the Republic of Indonesia, Susilo Bambang Yudhoyono in 2009. During the administration of the seventh President of the Republic of Indonesia, Joko Widodo, efforts to discuss the bill were renewed. Jokowi even sent a presidential letter (surpres) to the DPR to immediately discuss the Asset Confiscation Bill in May 2023. At that time, the bill was a government initiative bill. 

Unfortunately, even though there was a surpres, the 2019-2024 DPR did not discuss it until the end of its term of office.
